article aims to study the problem of requesting temporary release of the accused in criminal cases in the investigative officer&#8217;s class. By considering the problem that requires temporary release of the accused and the impact of not receiving the temporary release of the investigator According to the study, the reason for the request for temporary release of the accused in the criminal case Due to the Constitution of the Kingdom of Thailand Prof. 2017 Section 29, paragraph two, the provisions that &#8220;in criminal cases, it is assumed that the accused or defendant is not guilty. And before the final judgment indicates that any person who has committed an offense will not be able to treat that person as an offender.&#8221; Therefore, it is appropriate to release temporarily and the impact of not being released temporarily. The accused may have an impact on the fight because of the control of the accused. It is to cut off the opportunity to find evidence to fight in court or consult lawyers and the person who the accused trusts in fighting the case. And requesting temporary release in the investigator&#8217;s position. If there is an objection to bail of the investigator, the court will accept it for diagnosis of bail in court. Such conditions may cause injustice to the accused. Because such objections may be caused by personal reasons or interests involved. Despite the police regulations on the 7 cases, Regarding the temporary release, there are guidelines for investigators to practice. But at present, the problems caused by the temporary release consideration of the accused There are many problems, namely the authority to consider temporary release.
