Procedure Law requires the court to hear all evidence and not convict until they are certain that the accused committed the crime and that the accused was guilty. But according to the Criminal Procedure Code, section 176, paragraph one, gives the court the power to discretion not to take evidence before convicting the defendant who confessed. \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0If the offense has a minimum imprisonment rate of less than 5 years or an offense for which the minimum imprisonment rate is not specified, therefore, the provisions of section 176 paragraph one should be amended.
